Terms of sale
This English translation is provided for convenience. In the event of any discrepancy, the French version prevails.
These General Terms of Sale (the “Terms”) govern the contractual relationship between Oxyde Steel Guitars and any natural or legal person wishing to purchase an instrument made by the workshop. They apply to orders placed online, by email exchange or directly at the workshop.
1. Purpose and scope
Any order implies unreserved acceptance of these Terms, which prevail over any other document unless otherwise agreed in writing and signed by both parties.

3. Products, case and handmade character
Oxyde Steel Guitars instruments are handmade, as one-off pieces or in small numbered batches. Each piece shows slight natural variations in wood, patina and hand finishing. These variations are not defects but inherent features of handmade products.
Case. Instruments are sold without a case. For any shipment of a resonator, the optional hard case (approximately €150) must be added to the order. For electric models, the Plum’ Case aluminium hard case is available as an option (€668), subject to availability.
Photographs and descriptions on the website are as accurate as possible. For custom builds, the contractual specifications are those stated in the accepted quote.
4. Prices
Prices are stated in euros. VAT not applicable, article 293 B of the French General Tax Code. Shipping costs, any customs duties and import taxes are not included in the price of the instrument unless otherwise stated. They are communicated to the Customer before the balance is paid.
5. Reservation and order of available pieces
Reservation request. The “Request this piece” form allows the Customer to request the reservation of an instrument shown as available. Sending the form involves no payment and no firm commitment by the Customer or the workshop, and does not form the contract of sale. The piece is simply held in the Customer’s name while the request is processed.
Workshop reply. Within 24 hours, Oxyde Steel Guitars sends the Customer by email a summary of the piece, the total price, the 10% deposit amount, a unique transfer reference, the bank details, these Terms and the seven-calendar-day payment deadline.
Formation of the contract. The sale is formed upon receipt of the deposit in the workshop’s account. From that date, the piece is firmly reserved for the Customer and removed from public availability.
No transfer. If the deposit is not received within seven calendar days, the reservation is automatically cancelled. No contract is formed, no sum is owed by either party, and the piece may be offered for sale again.
6. Deposit, balance and cancellation
Deposit. The deposit amounts to 10% of the price of the instrument. It is a deposit (“acompte”), not a non-binding down payment (“arrhes”): it is deducted from the total price and evidences the commitment of both parties from receipt. It covers in particular preparation, setup, finishing time and the removal of the piece from public availability.
Balance. The 90% balance is payable before shipping or, for hand delivery, at the latest upon handover. Delivery only takes place after receipt of the full price, unless otherwise agreed in writing by the workshop.
Cancellation by the Customer. If the order is cancelled after receipt of the deposit, the deposit is retained by the workshop for material costs, time spent on the piece and its removal from public availability. If cancellation occurs once the piece has been finished or shipped, the workshop reserves the right to request performance of the order or compensation for the loss suffered, under the applicable conditions.
Cancellation by the workshop. In case of technical impossibility, force majeure, loss or damage of the piece, any deposit paid is refunded in full within 14 days. No other compensation may be claimed, except in case of proven fault by the workshop.
7. Custom builds
Any custom build request is subject to a quote specifying the agreed specifications, price, estimated lead time, deposit amount and any specific conditions. Work begins after written acceptance of the quote and receipt of the deposit. Unless otherwise stated in the quote, the 10% deposit and 90% balance rules of article 6 apply.
Lead times for custom builds are estimates, given the handmade nature of the work. Oxyde Steel Guitars keeps the Customer informed of progress.
8. Preparation, delivery and shipping costs
After receipt of the deposit, the workshop finishes the piece, including its setup, any dedicated numbering and the agreed personalisation. The delivery date and shipping costs are confirmed to the Customer before the balance is paid.
Instruments can be handed over in person or shipped in France and internationally with a suitable insured carrier. For deliveries outside the European Union, any customs duties, import taxes and clearance fees are payable by the Customer. Transfer of risk takes place in accordance with the applicable mandatory legal provisions.
9. Personalisation and right of withdrawal
Personalisation. Every instrument sold by Oxyde Steel Guitars is set up and strung to the Customer’s specifications, as stated in the reservation request: setup on request (string height and action, tuning, playing adjustments) and choice of strings. This work is carried out in the workshop, for that Customer, after the contract is formed.
Exclusion of the right of withdrawal. The instrument is therefore a good made to the consumer’s specifications or clearly personalised within the meaning of article L221-28, 3° of the French Consumer Code. The right of withdrawal cannot be exercised. The Customer is informed of this and expressly acknowledges it, by ticking a separate box, before sending the reservation request.
Orders without personalisation. If, exceptionally and by written agreement, an instrument is delivered without any personalisation, the fourteen-day right of withdrawal provided for in article L221-18 of the French Consumer Code applies under the legal conditions, return costs being borne by the Customer.
10. Warranties
Oxyde Steel Guitars commercial warranty. Each piece is covered by a two-year warranty against manufacturing defects from delivery. It does not cover normal wear, impacts, misuse, unsuitable maintenance, modification of the instrument by a third party or deliberate alteration of the oxidised finish.
Legal warranties. This commercial warranty is in addition to the applicable legal warranties of conformity and against hidden defects. Any claim should be sent to the contact details in article 2.
11. Liability and force majeure
Oxyde Steel Guitars cannot be held liable for non-performance or delayed performance of its obligations resulting from force majeure within the meaning of article 1218 of the French Civil Code, including accident, natural disaster, incapacity or hospitalisation. It cannot be held liable for damage resulting from use of the instrument not in accordance with its purpose.
12. Intellectual property
The designs, photographs, texts and graphic elements presented by Oxyde Steel Guitars remain its exclusive property and may not be reproduced without prior written permission.
13. Personal data
Information collected through the forms, including the Customer’s identity and contact details, is processed to manage the reservation request, the order and delivery. The Customer may exercise their rights in accordance with the website’s privacy policy by contacting the workshop at the details in article 2.
14. Mediation, governing law and disputes
In the event of a dispute, consumer Customers may use the following consumer mediation service free of charge: CM2C — 49 rue de Ponthieu, 75008 Paris, France — contact@cm2c.net.
These Terms are governed by French law. Failing an amicable settlement, the competent courts are determined in accordance with ordinary rules and the mandatory provisions applicable to consumers.
15. Acceptance
The Customer declares having read these Terms before sending a reservation request. Accepting the Terms and paying the deposit following the workshop’s reply constitute acceptance of the conditions applicable to the order.
